2. Who These Terms Apply To
2.1. These Terms apply to all orders placed through our website by customers located in the United Kingdom.
2.2. If you are a consumer, nothing in these Terms affects your mandatory statutory rights under applicable UK consumer law.
3. Age Restriction
3.1. You must be 18 years of age or older to purchase alcohol from us.
3.2. By placing an order containing alcoholic products, you confirm that you are at least 18 years old.
3.3. We operate a Challenge 25 policy. On delivery, if the recipient appears to be under 25 years of age, valid photographic identification may be required to prove they are 18 or over.
3.4. If valid identification is not provided, delivery may be refused and the goods may be returned to us.
4. Products
4.1. We take reasonable care to ensure that product descriptions, prices, images and availability information are accurate.
4.2. However, minor differences in packaging, labels, vintages or presentation may occur.
4.3. All products are offered subject to availability.
5. Ordering and Contract Formation
5.1. When you place an order through our website, you are making an offer to purchase goods from us.
5.2. A legally binding contract is formed only when we send you an order confirmation email accepting your order.
5.3. We may refuse or cancel an order before dispatch, including where:
- the goods are unavailable;
- there is an obvious pricing or listing error;
- we reasonably suspect fraud, misuse or unlawful activity;
- we cannot complete age verification or delivery compliance requirements;
- delivery to the requested address is not possible.
5.4. If we cancel an order after payment has been taken, we will refund you in accordance with these Terms.
6. Prices, Taxes and DDP Basis
6.1. All prices shown on the website are in GBP unless otherwise stated.
6.2. For orders accepted on a Delivered Duty Paid (DDP) basis, the total price shown at checkout includes, where applicable:
- delivery charges stated at checkout;
- UK VAT;
- UK Alcohol Duty;
- import duties; and
- customs clearance costs.
6.3. Unless expressly stated otherwise at checkout, we sell to UK customers on a DDP basis.
6.4. For an order accepted on a DDP basis, you should not be asked to pay additional import, customs or duty charges upon delivery.
7. Payment Methods
7.1. We may accept payment by one or more of the following methods:
- Bitcoin or Satoshis;
- Lightning Network;
- PayPal;
- any other payment method displayed at checkout.
7.2. Payment must be successfully authorised before dispatch.
8. Cryptocurrency Payments
8.1. If you choose to pay in Bitcoin or Satoshis, you acknowledge that cryptocurrency values are volatile.
8.2. For a standard cancellation or change-of-mind return, any refund may be made in the same amount of Satoshis originally received by us, unless we agree otherwise or applicable law requires a different outcome.
8.3. Nothing in this clause limits your statutory rights in relation to faulty, damaged, misdescribed or non-delivered goods.
8.4. Where applicable law requires a refund by reference to the GBP purchase price, we will comply with that law.
8.5. If goods are faulty, damaged or not as described, your remedies will be provided in accordance with applicable consumer law.
9. Delivery
9.1. We currently deliver only within the United Kingdom.
9.2. Estimated delivery times are provided for information only and are not guaranteed.
9.3. We will deliver to the address provided in your order confirmation.
9.4. Risk in the goods passes to you when the goods are delivered to the delivery address.
9.5. If delivery cannot be completed because:
- age verification fails;
- the recipient refuses delivery without lawful reason;
- the address is incorrect or incomplete; or
- the recipient repeatedly fails to accept delivery,
we may charge you for reasonable redelivery or return costs where permitted by law.
10. Ownership of Goods
10.1. Ownership of the goods passes to you only when:
- we have received payment in full; and
- the goods have been delivered to you.
11. Your Right to Cancel if You Are a Consumer
11.1. If you are a consumer, you generally have the right to cancel your order within 14 days after the day on which you receive the goods, without giving any reason.
11.2. To exercise this right, you must notify us by email at swisswine@swisswine.uk before the end of the cancellation period.
11.3. You must then send the goods back to us within 14 days of telling us that you wish to cancel.
11.4. You are responsible for the direct cost of returning the goods unless:
- the goods are faulty;
- the goods are not as described; or
- we have agreed otherwise.
11.5. You are only responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
11.6. We will refund you within 14 days after we receive the goods back or, if earlier, after you provide evidence that you have sent them back.
11.7. We will refund the standard delivery cost you paid, but not any enhanced or premium delivery charge.
12. Exceptions to the Right to Cancel
12.1. Your right to cancel does not apply where an exception under applicable law applies, including where goods:
- are made to your specifications or clearly personalised;
- are liable to deteriorate or expire rapidly;
- become mixed inseparably with other items after delivery; or
- are sealed goods not suitable for return for health or hygiene reasons, if unsealed after delivery.
12.2. If in doubt, please contact us before placing your order.
13. Faulty, Damaged or Incorrect Goods
13.1. If goods are faulty, damaged or not as described, you may be entitled to remedies under the Consumer Rights Act 2015, including repair, replacement, price reduction or refund, depending on the circumstances.
13.2. If your order arrives damaged or incorrect, please contact us as soon as reasonably possible at swisswine@swisswine.uk, ideally with:
- your order number;
- a description of the issue; and
- photographs of the packaging and goods where available.
13.3. This helps us process the issue more quickly.
14. Our Right to Cancel
14.1. We may cancel a contract and refund you if:
- the goods are unavailable;
- we are unable to deliver for legal or operational reasons;
- we reasonably suspect fraud or misuse;
- age verification requirements cannot be met; or
- there is an obvious pricing or listing error.
14.2. We will notify you and refund sums paid for undelivered goods.
15. Promotions, Discounts and Vouchers
15.1. Promotions, discount codes and vouchers are subject to any additional terms stated with the relevant offer.
15.2. Unless expressly stated otherwise:
- promotions cannot be combined;
- vouchers have no cash value; and
- we may withdraw or amend promotions at any time before a contract is formed.
16. Intellectual Property
16.1. All website content, branding, text, images, graphics, logos, product descriptions and other materials on this website are owned by us or our licensors and are protected by intellectual property laws.
16.2. You may use this website only for lawful personal shopping purposes.
16.3. You must not copy, reproduce, distribute, exploit or commercially use any website content without our prior written consent.

18. Limitation of Liability
18.1. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- breach of your statutory consumer rights.
18.2. Subject to clause 18.1 and to the maximum extent permitted by law:
- we are not liable for indirect or consequential losses; and
- we are not liable for delay or failure caused by events outside our reasonable control.
19. Privacy and Data Protection
19.1. We process personal data in accordance with applicable data protection law.

19.3. These Terms do not replace those notices.

21.3. If you are a UK consumer, you may bring proceedings in the courts of your part of the United Kingdom, in accordance with applicable law.

22.1. We may update these Terms from time to time.
22.2. The version published on the website at the time you place your order will apply to your contract.
